Terms and Conditions
1. Scope of application
For the business relationship between the operator of the Austrian Airlines Jetshop and the customer, the following General Terms and Conditions of Business apply in the version valid at the time of the order. The operator of the Austrian Airlines Jetshop does not recognise any deviating conditions of the customer unless the operator of the Austrian Airlines Jetshop has expressly agreed to their validity in writing.
2. Contractual partner, customer service
The purchase contract is concluded with the operator of the Austrian Airlines Jet Shop. Further information about us can be found in our imprint. For questions, complaints and objections you can contact our customer service Mo-Fr 9:00 - 14:00 o'clock under the telephone number 0800 799 760.
3. Conclusion of contract and withdrawal
By placing the products in the Austrian Airlines Jetshop, we make a binding offer to conclude a contract for these articles. The contract is concluded when you accept the offer for the goods contained in the shopping basket by clicking the order button. Immediately after submitting the order, you will receive another confirmation by e-mail. In the event of typing, printing or calculation errors on the website, the operator of the Austrian Airlines Jetshop is entitled to withdraw from the contract. All offers are valid while stocks last. If the supplier of the Austrian Airlines Jetshop does not supply the operator of the Austrian Airlines Jetshop with the ordered goods despite contractual obligations, the operator of the Austrian Airlines Jetshop is also entitled to withdraw from the contract. In this case, the customer will be informed immediately that the ordered product is not available. The purchase price already paid will be refunded immediately.
Unless otherwise agreed, the delivery will be made from stock to the delivery address indicated by the customer. The risk is transferred to the customer as soon as the delivery is handed over to the customer by the delivering parcel or postal service.
5. Shipping costs
Deliveries to Austria and Germany are free of shipping costs from an order value of € 90,-. For all orders below an order value of € 90,- the delivery costs mentioned in the section shipping costs will apply.
The payment is made by PayPal.
You pay the invoice amount via the online provider PayPal. You must be registered there or register first. After legitimation with the access data you can confirm the payment order to us. Your PayPal account will be debited immediately after your order has been placed.
If the customer defaults on payment, the operator of the Austrian Airlines Jet Shop is entitled to demand interest on arrears at a rate of 4% above the base rate per annum announced by the Austrian National Bank (ÖNB). If the operator of the Austrian Airlines Jet Shop can be proven to have incurred higher damages due to the delay, the operator of the Austrian Airlines Jet Shop is entitled to claim these damages.
The customer must pay all amounts without deduction no later than 7 days after receipt of the request for payment; the receipt of the amount in one of our business accounts is decisive. If the deadline expires without success, the order will be removed from the programme without further notification.
8. Set-off, retention
You are only entitled to offsetting if your counterclaims have been legally established or recognised in writing by the operator of the Austrian Airlines Jet Shop. Furthermore, you are only entitled to exercise a right of retention if your counterclaim is based on the same contractual relationship.
9. Retention of title
The delivered goods shall remain the property of the operator of the Austrian Airlines Jet Shop until all claims against the customer have been settled in full.
10. Warranty for defects and liability
In the event of a defect in the purchased item for which the operator of the Austrian Airlines Jet Shop is responsible, the operator of the Austrian Airlines Jet Shop is entitled to choose whether to rectify the defect or deliver a replacement. If the operator of the Austrian Airlines Jet Shop is not willing or able to remedy the defect/replacement delivery, or if this is delayed beyond a reasonable period of time for reasons for which the operator of the Austrian Airlines Jet Shop is responsible, or if the remedy/replacement delivery fails in any other way, the customer is entitled to withdraw from the contract or demand a corresponding reduction in the purchase price, at his own discretion. Unless otherwise stated below, further claims of the customer, regardless of the legal grounds, are excluded. The operator of the Austrian Airlines Jet Shop shall therefore not be liable for damages which have not occurred to the delivery item itself; in particular, the operator of the Austrian Airlines Jet Shop shall not be liable for loss of profit or other financial losses of the customer.
11. Transport damage
If goods with obvious transport damages are delivered, please complain about such errors as soon as possible to the deliverer and please contact us immediately. Failure to make a complaint or contact us will not have any consequences for your legal claims and their enforcement, especially your warranty rights. However, you help us to be able to assert our own claims against the carrier or transport insurance.
12. Applicable law and place of jurisdiction
Austrian law shall apply. Exclusive place of jurisdiction for all claims in connection with the business relationship is 1030 Vienna. The operator of the Austrian Airlines Jet Shop is also entitled to take legal action at the customer's general place of jurisdiction.
13. Cancellation policy
Right of withdrawal
Customers who are consumers within the meaning of the Austrian Consumer Protection Act have the right to revoke this contract within fourteen days without giving reasons. The revocation period is fourteen days from the day on which you or a third party named by you has taken possession of the goods or, in the case of a separate delivery, the last goods have been taken into your possession.
In order to exercise your right of withdrawal, you must inform us by means of a clear statement (e.g. a letter or e-mail sent by post) of your decision to withdraw from this contract. The statement needs to be addressed to:

In order to comply with the revocation period, it is sufficient to send the notification of the exercise of the right of revocation before the end of the revocation period.
Consequences of revocation
In the event of an effective revocation, the services received by both parties are to be returned and any benefits derived (e.g. interest) surrendered. If you are unable to return the received services and benefits (e.g. benefits of use) or only partially or only in a deteriorated condition, you must compensate us for the value. For the deterioration of the goods and for the use of the goods, you must only pay compensation if the use or deterioration is due to handling of the goods that goes beyond the examination of the properties and functionality. The term "testing of the properties and functionality" means the testing and trying out of the respective goods, as is possible and usual in a retail shop.
If you revoke this contract, we must refund all payments we have received from you, including delivery costs (with the exception of additional costs resulting from the fact that you have chosen a different type of delivery from the cheapest standard delivery offered by us), immediately and at the latest within fourteen days from the day on which we receive notification of your revocation of this contract. For this refund, we will use the same means of payment that you used for the original transaction, unless expressly agreed otherwise with you; in no event will you be charged for this refund. We may refuse to refund until we have received the goods back or until you have provided proof that you have returned the goods, whichever is earlier. Obligations to refund payments must be fulfilled within 30 days. For you, the period begins with the dispatch of your declaration of revocation or the goods, for us with their receipt.
You must return the goods without delay and in any case within fourteen days at the latest from the day on which you inform us of the revocation of this contract to

The time limit shall be deemed to have been observed if you send the goods before the end of the fourteen-day period.
The right of revocation does not apply, among other things, to contracts for the delivery of goods,
- which are manufactured according to customer specifications or are clearly tailored to personal requirements
- which are not suitable for return due to their nature
- which can spoil quickly or whose expiry date has been exceeded,
- which contain audio or video recordings, if the delivered data carriers have been unsealed by you.

14. Cost bearing agreement when exercising the right of withdrawal
You shall bear the direct costs of returning the goods if the delivered goods correspond to those ordered.

The language available for the conclusion of the contract is German.
